US-Berufungsgericht weist Gebührenrahmen der Federal Reserve für Debitkartenzahlungen zurück

US-Appell

A US appeals court has upheld a judgment vacating the Federal Reserve’s debit-card interchange fee regulation, finding that the agency included costs Congress had instructed it to exclude.

The Eighth Circuit’s October 26 decision in Corner Post v. Federal Reserve concerns how regulated fees are calculated. It does not establish a replacement rate or guarantee an immediate reduction in merchants’ payment-processing bills.

Wichtige Erkenntnisse

  • The court affirmed the judgment against the Federal Reserve’s existing fee framework.
  • The disputed formula includes a 21-cent base cap, plus percentage and qualifying fraud-prevention components.
  • The decision centres on which processing costs the regulator may consider.
  • Implementation depends on further court proceedings and regulatory action.

Why the Court Rejected the Formula

Das Stellungnahme des Gerichts interprets the Durbin Amendment as requiring the Federal Reserve to distinguish the incremental cost of processing a particular debit transaction from costs that are not specific to it.

The panel rejected the agency’s inclusion of certain fixed expenses in its calculation.

For example, purchasing fraud-detection software can involve an upfront expense that does not increase with every additional transaction. The legal question was whether such costs belonged in the regulated fee calculation—not whether fraud prevention matters.

Interchange Is One Part of a Merchant’s Bill

Interchange compensates the bank issuing the customer’s debit card and is generally paid through the merchant’s bank. The regulated framework applies to covered debit-card issuers with more than $10 billion in assets.

It should not be confused with the complete price a merchant pays its processor.

Businesses comparing Zahlungs-Gateways may encounter bundled pricing that combines several services. A change to one underlying charge does not necessarily translate into an identical change in the merchant’s contracted rate.

No Replacement Fees Have Been Set

As Consumer Finance Monitor’s analysis explains, the practical effect depends partly on the appellate mandate, possible further appeals and the Federal Reserve’s subsequent proceedings.

Merchants therefore cannot assume the decision has already changed the fees charged on their next transaction.

The same care applies when comparing cards with Krypto-Zahlungsabwicklung. Different payment methods have different cost components, including network charges, service fees and currency conversion.

A payment gateway’s role also extends beyond transmitting funds. Integration, reconciliation and settlement services can affect the overall commercial price.

Fazit

The ruling challenges the legal basis of the Federal Reserve’s existing debit interchange calculation. Its financial effect on merchants remains unsettled: a court decision against the formula is a significant development, but it is not yet a replacement fee schedule.
